1. About this notice
This notice explains how Bashkal Consultancy Ltd ("Bashkal", "we", "us" or "our") collects, uses and protects your personal data, and your rights in relation to it. It applies to clients, prospective clients, and others we deal with in the course of our planning, architectural design and development consultancy services.
Bashkal Consultancy Ltd is the "controller" of your personal data for the purposes of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We are registered with the Information Commissioner's Office (ICO), registration reference ZB731540.
2. The personal data we collect
Depending on our relationship with you, we may collect and process the following categories of personal data:
- Identity and contact details — your name, postal address, email address and telephone number.
- Property and project information — the address and details of the property or site, ownership information, plans, surveys, photographs and planning history.
- Financial and transactional data — billing details and records of payments. We accept payment by bank transfer and card; card payments are processed by our payment providers and we do not store full card details.
- Correspondence — records of our communications with you and notes relating to your project.
- Website and technical data — where you use our website, limited technical data such as IP address and information collected via cookies (see section 9).
We do not generally collect special category data. Where an application relates to accessibility or adaptations for a disabled person, we may need to process limited health-related information; we will only do so where necessary and with an appropriate lawful basis.
3. How we collect your data
- Directly from you, when you enquire (including via the enquiry form on our website), instruct us, or correspond with us.
- From people acting on your behalf, such as your architect, agent, contractor or solicitor.
- From publicly available sources and registers, such as HM Land Registry, local planning authority records and the Planning Portal.
- Automatically, when you interact with our website.
4. How we use your data and our lawful bases
We use your personal data for the following purposes and rely on the following lawful bases under the UK GDPR:

Where we rely on legitimate interests, we have considered and balanced these against your rights and interests.
5. Who we share your data with
We share personal data only where necessary, with:
- Third-party consultants and contractors appointed for your project (for example structural engineers, ecologists, arboriculturalists and builders).
- Local planning authorities, building control bodies, the Planning Portal and other statutory or regulatory bodies.
- HM Land Registry and other public registers, where required for your project.
- Our professional advisers, including accountants, solicitors and insurers.
- IT and cloud service providers who host our systems and the software we use to quote, manage projects, store documents and process accounts.
- Payment providers, and, where necessary, debt recovery agencies.
- Regulators, courts and law enforcement, where we are required to do so by law.
6. International transfers
Some of our service providers may process personal data outside the United Kingdom. Where they do, we ensure an appropriate safeguard is in place — such as the country being covered by UK adequacy regulations, or the use of the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.
7. How long we keep your data
We keep your personal data for as long as we are providing services to you, and afterwards for at least six years from completion of the relevant work, to reflect the period in which a claim could be brought and to meet our legal, tax and insurance obligations. Some records may be kept for longer where the law requires. When data is no longer needed, we securely delete or anonymise it.

Under data protection law you have the right to:
- Be informed about how we use your personal data (which this notice provides).
- Request access to the personal data we hold about you.
- Ask us to correct inaccurate or incomplete data.
- Ask us to erase your data in certain circumstances.
- Ask us to restrict or object to our processing in certain circumstances.
- Request the transfer (portability) of your data in certain circumstances.
- Withdraw your consent at any time where we rely on consent.
To exercise any of these rights, please contact us using the details in section 11. We will not normally charge a fee and will respond within one month.

Our website uses cookies. Essential cookies are necessary for the site to function; non-essential cookies (for example analytics) are only used with your consent, which you can manage or withdraw at any time. Further detail is provided in our cookie settings on the website.
